The Legal Reality: Eligibility is based on Status, not the physical document. If you were registered as a British National (Overseas) before 1 July 1997, you hold the status for life.

Bringing the Next Generation (Born Post-1997).

 

Children born after 1 July 1997 are not BN(O)s themselves. However, they can still apply.

The 'High Potential' Independent Route: If your child is 18+ and born on/after 1 July 1997, they can now apply independently if one parent holds BN(O) status. They do not need to live with you.

The 'Dependent' Route: For children under 18 or those who are financially reliant, they apply as your dependents. We must prove they form part of your 'household' in Hong Kong.

The Eligibility Criteria

  • Proving Ordinary Residence.

    To apply, you must prove your permanent home is in Hong Kong (if applying from outside) or the UK (if switching).

    The Evidence: We compile a portfolio of:

    - Utility bills and Tenancy Agreements.

    - Tax records and Employment letters.

    - Warning: Attempting to apply while living in a third country (e.g., Taiwan or Australia) often leads to refusal unless careful arguments are made.

  • The "Survival" Calculation

    You must prove you can support your entire family for 6 months without working.

    The Evidence:

    - Cash Savings: Liquid funds held in your name.

    - Income: Salary from a job transferred to the UK.

    - Accommodation: Upfront rental payments or a friend's offer of accommodation.

    - Exemption: If you have already lived in the UK for 12 months on another visa, you are exempt from this financial check.

Settlement & Citizenship (The Timeline)

  • Live and work in the UK. No salary threshold. Access to NHS.

  • Apply for Indefinite Leave to Remain (ILR). You must pass the Life in the UK Test and have no serious criminal record."

  • Apply for British Citizenship. As a BN(O), you are entitled to register as a full British Citizen after 12 months of settlement.
