Are they Joining you or Switching?

The rules differ depending on where your child is currently located. We select the correct Paragraph of the Immigration Rules to prevent invalid applications.

 

Paragraph 297 (From Abroad): For children outside the UK joining a settled or British parent. Successful applicants receive Indefinite Leave to Enter (ILE) immediately. They land in the UK as permanent residents.

Paragraph 298 (From Within the UK): For children already in the UK (e.g., as a dependent) whose parents have now settled. They switch directly to Indefinite Leave to Remain (ILR).

The "Sole Responsibility" Trap.

If the child's other parent is still alive and living overseas, you must prove you have 'Sole Responsibility' for the child's upbringing.

    If Sole Responsibility cannot be proven (e.g., the other parent is involved), we argue under Paragraph 297(i)(f). We must prove there are 'serious and compelling family or other considerations' which make the child’s exclusion undesirable.

The "Maintenance & Accommodation" Check

  • Financial Adequacy.

    While ILE/ILR gives you access to public funds, we must prove for the application that the family can be supported at the 'Income Support' level. We use the official formula (A – B ≥ C) to prove your net income exceeds the minimum required for a family of your size.

  • The Bedroom Standard.

    The Home Office will check how many rooms are in your house. We review your property inspection report to ensure adding the child does not breach statutory overcrowding limits.

  • Under 18 / Not Independent.

    The child must be under 18 at the date of application. If they are older, they must not be living an 'independent life' (married or financially separate). We audit their dependency status.

Child Settlement FAQs

  • As long as the application was submitted before their 18th birthday, they are protected. The Home Office considers their age at the date of application, not the date of decision. This is why timing the submission is critical.

  • No. Unlike the Partner route, Child Settlement under Paragraph 297/298 uses the 'Adequate Maintenance' test (Income Support level). This is generally lower than the strict financial requirement for spouses, but the calculation is more complex.

  • Yes, but it is harder. You must prove that the step-child is part of your family unit and that the other biological parent is not involved in a way that makes exclusion undesirable. We often need to prove the 'family life' exists with you specifically.

  • Ideally, yes. However, if you are claiming 'Sole Responsibility,' asking for consent can sometimes backfire (as it implies they still have authority). We assess whether to include a consent letter or argue that their consent is irrelevant because they have abdicated responsibility.

  • Only for 'De Facto' adoptions (where you have lived with the child for 12+ months before applying) or adoptions recognized by UK law. Hague Convention adoptions are straightforward; informal adoptions require extensive evidence of the transfer of parental responsibility.
